Three of the firm’s attorneys discuss bicycle accident litigation in Washington, DC — including dooring, bike lane violations, and how the District’s Vulnerable User Recovery Act allows cyclists to recover damages even when partially at fault. The firm has secured over $3.5 million for a cyclist who suffered a traumatic brain injury in a dooring incident.

**Speakers:** Joseph Cammarata, Stephen Ollar, Allan Siegel

**Allan Siegel:**

Being in the District of Columbia, which is a very bicycle friendly city, we get a lot of bicycle crashes. A lot of clients who are involved in bicycle crashes reach out to us and we’ve been handling them for years. Whether or not it’s somebody driving in a bike lane and somebody makes a turn and infringes upon the bike lane, whether it’s somebody who gets “doored” by another vehicle, in other words, a driver stops and opens his door while the bicyclist is driving with the right of way. That actually is against the law in the District of Columbia. You’re required to look before you open your door or whether or not it’s just a case where a bicycle’s riding on the roadway and with the right of way and a vehicle makes a turn or rear ends them. We get a lot of them, and we’ve been handling them for many, many years and very successfully.

**Stephen Ollar:**

Really, when you look at the law in DC what we talk about is vulnerable riders. So it’s not just bicyclists, it’s also motorcyclists. It’s people on e-scooters, even pedestrian, all of them who are, anybody who’s not inside a four wheeled vehicle, falls under that kind of category of a vulnerable user. And so the law in that area is consistent across the board. The law now in the District Columbia, is that if you fall into that kind of category, you could be up to 50% at fault and still be able to get a recovery. You can’t be more than 50% at fault, but as long as you’re 50% or less, you’re still eligible to get a recovery. So we do a lot of those cases and providing representation for people over hurt in those categories.

**Joseph Cammarata:**

So it’s important to reach out to a lawyer that knows what they’re talking about that’s going to be aggressive and going to be able to establish that your fault was slight, if any, and that you have a full opportunity to receive compensation for the harms and losses that you suffered.

## Are E-Bike Injuries More Severe Than Regular Bicycle Injuries?

Electric bikes have surged in popularity throughout the Washington, D.C., metropolitan area over the past several years. Commuters, recreational riders, and delivery workers increasingly rely on these motorized bicycles to navigate the city’s streets and bike lanes. As e-bike usage has expanded, so too have reports of e-bike accidents and related injuries. Local emergency rooms have documented a notable uptick in treatment for e-bike related injuries, with many cases involving [more serious trauma than what medical professionals typically see with traditional bicycles](https://www.chaikinandsherman.com/bicycle-accidents/electric-bicycles/how-is-an-e-bike-different-from-a-bicycle/). This growing trend has raised safety concerns among healthcare providers, city planners, and residents alike about the unique risks these vehicles pose to riders and pedestrians.

If you’ve suffered injuries in an [e-bike accident](https://www.chaikinandsherman.com/bicycle-accidents/electric-bicycles/) caused by another person’s negligence, [Chaikin, Sherman, Cammarata, & Siegel, P.C.](https://www.chaikinandsherman.com/bicycle-accidents/) can help you pursue the compensation you deserve. Our experienced personal injury attorneys understand the complexities of e-bike accident cases and work diligently to hold negligent parties accountable. Whether your accident involved a careless driver, defective equipment, or hazardous road conditions, we’ll investigate your claim thoroughly and fight for fair recovery of your medical expenses, lost wages, and pain and suffering. **[Contact us](https://www.chaikinandsherman.com/contact-us/) today to schedule a free consultation** and learn how we can help you move forward after an e-bike accident.

## What Are E-Bikes?

Electric bicycles combine traditional pedaling with battery-powered assistance through an electric motor. Unlike motorcycles or e-scooters, e-bikes require pedaling to engage the motor, though the level of assistance varies by model and rider preference. The Consumer Product Safety Commission recognizes three distinct classes of electric bikes:

- **Class 1 E-Bikes** – Pedal-assist only with no throttle. The electric motor provides assistance only when the rider pedals and stops helping at 20 mph. These are the most common type found on bike sharing systems and are generally permitted on bike paths and lanes.

- **Class 2 E-Bikes** – Throttle-assisted with a maximum speed of 20 mph. Riders can engage the motor without pedaling by using a throttle, similar to e-scooters. These bikes offer greater convenience but may face more restrictions on where they can legally operate.

- **Class 3 E-Bikes** – Pedal-assist only with assistance up to 28 mph. These high-speed models are designed for commuters covering longer distances quickly. Many jurisdictions restrict their use on traditional bike paths due to the increased speeds they can achieve.

## Are E-Bikes More Dangerous Than Traditional Bikes?

Research indicates that riding e-bikes does carry heightened risks compared to traditional bicycles. While electric bikes offer many benefits for transportation and recreation, several factors contribute to their increased danger profile. Understanding these risk factors helps riders make informed decisions about safety precautions and riding behavior.

### Higher Speeds

The electric motor allows riders to reach and maintain significantly faster speeds with less physical effort than traditional bicycles. Class 3 e-bikes can travel nearly 30 mph with pedal assistance, while most casual riders on regular bikes average 12-15 mph. These elevated speeds reduce reaction time when hazards appear and increase stopping distances. When collisions occur at higher velocities, the resulting impact forces are substantially greater, leading to more severe injuries. Speed also affects a rider’s ability to navigate tight spaces and make quick directional changes safely.

### Increased Weight

E-bikes typically weigh between 50 and 70 pounds due to their electric motor, battery pack, and reinforced frame—roughly double the weight of traditional bicycles. This additional mass affects handling characteristics and requires greater braking force to stop safely. In collision scenarios, the extra weight translates to increased momentum and impact energy. Heavier bikes are also more difficult to control during emergency maneuvers and harder to stabilize when balance is lost. If an e-bike falls on a rider during a crash, the added weight can cause additional crush injuries.

### Inexperienced Riders

The motor assistance makes riding an e-bike accessible to people with limited cycling experience or physical fitness. Many first-time e-bike riders lack the skills and instincts that experienced cyclists develop over years of riding. New riders may not understand proper braking technique, traffic positioning, or how to handle the bike in various road conditions. The ease of acceleration can give inexperienced riders false confidence, leading them to attempt maneuvers beyond their actual skill level. Additionally, riders accustomed to traditional bicycles must adjust to the different weight distribution and handling dynamics of electric bikes.

### Battery and Electrical Hazards

While relatively rare, battery failures pose unique dangers not present with traditional bicycles. Lithium-ion batteries can overheat, catch fire, or explode if damaged, improperly charged, or defectively manufactured. These incidents can occur while riding, during charging, or even when the bike is stored. Electrical system malfunctions may cause unexpected motor engagement or failure, potentially causing riders to lose control. Water damage to electrical components from riding in rain or through puddles can create additional safety risks.

## How Can E-Bike Injuries Be More Severe Than Regular Bike Injuries?

Studies examining bicycle injuries and electric [bicycle injuries](https://www.chaikinandsherman.com/bicycle-accidents/common-injuries-from-bicycle-accidents-in-washington-dc/) have found that e-bike riders experience more serious injuries on average than those riding traditional bicycles. Medical data from emergency departments shows e-bike accidents result in higher hospitalization rates and more significant trauma requiring extended treatment.

- **Greater impact forces** – The combination of higher speeds and increased vehicle weight creates substantially more kinetic energy during crashes. When an e-bike traveling at 25 mph strikes an object or the ground, the impact forces are multiple times greater than a traditional bicycle crash at 12 mph. These amplified forces cause more severe tissue damage, bone fractures, and internal injuries.

- **[Head trauma](https://www.chaikinandsherman.com/brain-injuries/treatment-for-traumatic-brain-injury/)** – Despite bicycle helmet usage, e-bike riders suffer head injuries at elevated rates and severity levels. The higher crash speeds exceed the protection thresholds of standard bicycle helmets, which are typically tested at lower impact velocities. Traumatic brain injuries, skull fractures, and severe concussions occur more frequently in e-bike accidents than traditional bike crashes.

- **Pedestrian and cyclist collisions** – When e-bikes collide with pedestrians or slower-moving cyclists, the speed differential creates dangerous impact scenarios. Traditional bike and e-scooter collisions typically involve similar speeds, but e-bikes can strike unsuspecting individuals with much greater force. These crashes often result in serious injuries to both parties, particularly vulnerable road users like children and elderly pedestrians.

- **Multi-vehicle accidents** – E-bike riders traveling at higher speeds are more likely to be involved with motor vehicle traffic. Drivers may misjudge the speed of approaching e-bikes, pulling out in front of riders or turning across their path. When motor vehicle collisions occur, the speed of the e-bike contributes to more catastrophic outcomes than typical bicycle accidents.

- **Loss of control incidents** – The additional weight and speed make e-bikes more difficult to control when navigating obstacles, potholes, or slippery surfaces. Riders who lose control at higher speeds have less opportunity to recover before crashing. The momentum carried by a fast-moving e-bike makes low-speed falls that would be minor on a traditional bicycle result in significant trauma.

## What Are Some Common E-Bike Injuries?

E-bike accidents produce a range of injuries from minor to life-threatening. Emergency departments throughout Washington, D.C., regularly treat patients with the following [common injuries](https://www.chaikinandsherman.com/bicycle-accidents/common-injuries-from-bicycle-accidents-in-washington-dc/) from e-bike crashes.

### Head Injuries

[Traumatic brain injuries](https://www.chaikinandsherman.com/brain-injuries/) represent the most concerning category of e-bike related injuries due to their potential for permanent disability or death. Even riders wearing bicycle helmets can sustain concussions, contusions, and skull fractures when crashes occur at elevated speeds. Severe head trauma may result in brain bleeding, swelling, and lasting cognitive impairment. Studies show hospitalization rates for head injuries are significantly higher among e-bike riders compared to traditional bicycle users.

### Facial and Dental Injuries

The face and jaw frequently absorb impact forces when riders fall forward over the handlebars or strike objects. Facial fractures involving the cheekbones, eye sockets, nose, and jaw require extensive surgical repair and recovery time. Dental injuries including knocked-out teeth, fractured roots, and jaw damage necessitate emergency dental treatment and ongoing restorative work. Road rash and lacerations to facial tissue often leave permanent scarring despite medical intervention.

### Orthopedic Injuries

Broken bones occur regularly in e-bike accidents as riders instinctively extend their arms to break falls or absorb collision impacts. Wrist and forearm fractures are particularly common, along with collarbone breaks from shoulder-first impacts. Hip fractures, pelvis injuries, and leg fractures happen when riders are struck by motor vehicles or thrown from their bikes at high speeds. Many orthopedic injuries require surgical repair with plates, screws, or rods, followed by months of physical rehabilitation.

### [Spinal Cord Injuries](https://www.chaikinandsherman.com/car-accidents/spine-injuries/)

The force of high-speed crashes can cause vertebral fractures, herniated discs, and damage to the spinal cord itself. Neck injuries from whiplash-type motions or direct impacts may result in cervical spine damage with neurological consequences. Serious spinal cord trauma can lead to partial or complete paralysis, requiring lifetime medical care and assistance. Even less severe spinal injuries often cause chronic pain and mobility limitations that affect quality of life long-term.

### Internal Injuries

Blunt force trauma to the torso during e-bike accidents can damage internal organs and cause life-threatening internal bleeding. Rib fractures may puncture lungs or lacerate the liver and spleen. Abdominal injuries might not be immediately apparent but can rapidly deteriorate without prompt medical intervention. Internal injuries frequently require emergency surgery and extended hospitalization for recovery.

### Road Rash and Soft Tissue Damage

Sliding across pavement during a crash strips away layers of skin, creating painful abrasions that cover large body areas. Severe road rash requires wound cleaning, debridement, and sometimes skin grafting to heal properly. Soft tissue injuries including deep lacerations, muscle tears, and ligament damage cause significant pain and functional impairment. These injuries carry high infection risk and may leave permanent scarring or reduced range of motion.

## What Should I Do If I Am Injured In a Washington, D.C., E-Bike Accident?

Taking appropriate steps immediately after an e-bike accident protects your health and preserves your legal rights to seek compensation. Follow these important actions if you’re involved in an e-bike crash:

- **Seek immediate medical attention** – Call 911 or have someone transport you to an emergency room, even if injuries seem minor initially. Some serious injuries like internal bleeding or brain trauma may not produce obvious symptoms right away. Medical documentation created immediately after your accident provides crucial evidence linking your injuries to the crash.

- **Report the accident to police** – Contact law enforcement to file an official accident report, particularly if the crash involved a motor vehicle, another cyclist, or significant property damage. The police report creates an independent record of the accident circumstances, contributing factors, and involved parties’ statements that proves valuable during insurance claims or legal proceedings.

- **Document the accident scene** – If physically able, photograph the crash location, vehicle damage, road conditions, traffic signs, and your visible injuries. Collect contact information from witnesses who saw the accident occur. Note specific details about how the crash happened while memories remain fresh, including weather conditions, lighting, and traffic patterns.

- **Preserve evidence** – Keep your damaged e-bike, helmet, clothing, and any other equipment involved in the crash. Do not repair or dispose of these items as they may provide important evidence about the accident dynamics and defective equipment issues. Take photographs of all damaged property from multiple angles.

- **Avoid giving recorded statements** – Insurance adjusters may contact you seeking recorded statements about the accident. Politely decline these requests until you’ve consulted with an attorney, as your words can be used to minimize or deny your claim later. Never admit fault or apologize for the accident in conversations with other parties or insurers.

- **Keep detailed records** – Maintain organized files of all medical bills, treatment records, prescription receipts, and other accident-related expenses. Document how your injuries affect your daily activities, work, and quality of life. Save correspondence with insurance companies and other involved parties.

- **Consult a personal injury attorney** – Contact an experienced e-bike accident lawyer as soon as possible after your crash. Early legal representation ensures evidence is preserved, witnesses are interviewed promptly, and your rights are protected during insurance negotiations. Attorneys can handle communications with insurers while you focus on recovery.

## How Will a Personal Injury Lawyer Help Me After an E-Bike Accident In Washington, D.C.?

Navigating the aftermath of an e-bike accident involves complex legal and insurance matters that benefit significantly from professional representation. An experienced personal injury attorney provides essential services throughout your recovery and claim process.

### Investigation and Evidence Gathering

Your attorney will conduct a thorough investigation into the circumstances surrounding your accident to build a strong case for compensation. This includes obtaining police reports, medical records, and witness statements that support your version of events. Lawyers work with accident reconstruction experts when necessary to analyze the crash dynamics and establish liability. They’ll preserve critical evidence like surveillance footage that might otherwise be lost or destroyed. A complete investigation identifies all potentially liable parties, including negligent drivers, property owners, or e-bike manufacturers.

### Determining Liability and Negligence

Personal injury lawyers understand how to analyze the facts of your case to establish who bears legal responsibility for your injuries. They’ll review whether the other party violated traffic laws, rode recklessly, or otherwise acted negligently in causing the accident. In cases involving defective e-bike components, attorneys can pursue product liability claims against manufacturers. Your lawyer will also assess comparative negligence issues under D.C. law that might affect your recovery. Proper liability determination ensures you pursue compensation from all appropriate parties.

### Calculating Full Damages

Attorneys ensure you seek compensation for the complete scope of your injuries and losses, not just immediate medical bills. They work with medical experts to understand the long-term treatment needs and future costs associated with your injuries. [Economic damages](https://www.chaikinandsherman.com/car-accidents/economic-vs-non-economic-damages/) include medical expenses, lost wages, reduced earning capacity, and property damage. [Non-economic damages](https://www.chaikinandsherman.com/car-accidents/economic-vs-non-economic-damages/) address pain and suffering, emotional distress, loss of enjoyment of life, and permanent disability or disfigurement. Lawyers prevent you from accepting inadequate settlement offers that fail to account for your total damages.

### Negotiating With Insurance Companies

Insurance adjusters work to minimize payouts and protect their company’s financial interests, not yours. Your attorney handles all communications with insurance companies, preventing them from using your statements against you. Lawyers understand insurance policy language, coverage limits, and negotiation tactics that maximize settlement values. They’ll push back against lowball offers and bad faith insurance practices. Having legal representation signals you’re serious about obtaining fair compensation, which often leads to better settlement outcomes.

### Litigation if Necessary

When insurance companies refuse to offer reasonable settlements, your attorney can file a lawsuit and take your case to trial. Lawyers manage all aspects of litigation including drafting complaints, conducting discovery, taking depositions, and presenting evidence in court. They’ll prepare you to testify effectively and retain expert witnesses to support your claims. Most cases settle before trial, but having an attorney willing and able to litigate creates leverage in settlement negotiations. You can focus on healing while your lawyer handles the legal complexities.
