Three of the firm’s attorneys discuss bicycle accident litigation in Washington, DC — including dooring, bike lane violations, and how the District’s Vulnerable User Recovery Act allows cyclists to recover damages even when partially at fault. The firm has secured over $3.5 million for a cyclist who suffered a traumatic brain injury in a dooring incident.

**Speakers:** Joseph Cammarata, Stephen Ollar, Allan Siegel

**Allan Siegel:**

Being in the District of Columbia, which is a very bicycle friendly city, we get a lot of bicycle crashes. A lot of clients who are involved in bicycle crashes reach out to us and we’ve been handling them for years. Whether or not it’s somebody driving in a bike lane and somebody makes a turn and infringes upon the bike lane, whether it’s somebody who gets “doored” by another vehicle, in other words, a driver stops and opens his door while the bicyclist is driving with the right of way. That actually is against the law in the District of Columbia. You’re required to look before you open your door or whether or not it’s just a case where a bicycle’s riding on the roadway and with the right of way and a vehicle makes a turn or rear ends them. We get a lot of them, and we’ve been handling them for many, many years and very successfully.

**Stephen Ollar:**

Really, when you look at the law in DC what we talk about is vulnerable riders. So it’s not just bicyclists, it’s also motorcyclists. It’s people on e-scooters, even pedestrian, all of them who are, anybody who’s not inside a four wheeled vehicle, falls under that kind of category of a vulnerable user. And so the law in that area is consistent across the board. The law now in the District Columbia, is that if you fall into that kind of category, you could be up to 50% at fault and still be able to get a recovery. You can’t be more than 50% at fault, but as long as you’re 50% or less, you’re still eligible to get a recovery. So we do a lot of those cases and providing representation for people over hurt in those categories.

**Joseph Cammarata:**

So it’s important to reach out to a lawyer that knows what they’re talking about that’s going to be aggressive and going to be able to establish that your fault was slight, if any, and that you have a full opportunity to receive compensation for the harms and losses that you suffered.

## Washington, DC Bike Lanes, and Their Dangers

As the popularity of cycling continues to grow in Washington, DC, so does the need for proper bike infrastructure. The city’s network of bike lanes is designed to make cycling safer and more accessible, but these lanes are not without risks. From poor maintenance to reckless drivers, there are many dangers associated with DC’s bike lanes that cyclists must be aware of.

You may be entitled to compensation if you or a loved one has been injured in a[ bicycle accident](https://www.chaikinandsherman.com/bicycle-accidents/). The law firm of Chaikin, Sherman, Cammarata, & Siegel, P.C. fights for justice for bicycle accident victims. Please don’t hesitate to contact us for a[ free consultation](https://www.chaikinandsherman.com/contact-us/) today.

## What Makes DC Bike Lanes So Dangerous?

Advocates argue that despite the District Department of Transportation (DDOT) constructing 104 miles of bicycle lanes since 2002 and presently maintaining over 150 miles of recreational trails and bike lanes in the District, much remains to be accomplished.

### The Bike Network Is Incomplete

The bike network being incomplete is arguably the most significant danger to cyclists in DC. Despite the efforts of DDOT, the bike network in Washington, DC, is far from complete. Cyclists still face several challenges when navigating the city’s bike lanes.

#### Gaps in the Bike Lane Network

Another problem with DC’s bike network is the gaps in the bike lane system. While some parts of the city have well-established bike lanes, others have almost no infrastructure. This creates what is known as a “bike lane desert,” where cyclists are forced to ride on busy streets without any protection from cars or other vehicles.

#### Disconnected Bike Lanes

DC’s bike network lanes are often disjointed and disconnected from one another. This makes it difficult for cyclists to navigate the city safely and efficiently. In many cases, bike lanes abruptly end with no warning, forcing cyclists to merge into traffic with little space or protection.

#### Inequitable Distribution of Bike Lanes

Finally, the distribution of bike lanes across the city is unequal. Wealthier neighborhoods tend to have more bike lanes and better infrastructure. At the same time, lower-income communities are often left with poor-quality roads and little bike infrastructure. This unequal distribution can make it much more difficult for residents of these areas to commute by bike. It can also create further barriers to mobility and economic opportunity.

### Poor Maintenance of Bike Lanes

The poor maintenance of bike lanes is another significant danger for cyclists in DC. Despite the city’s efforts to create a safe and efficient cycling network, many bike lanes are in disrepair, making them difficult and dangerous to use. Damage from construction work, debris, potholes, and other hazards can be found on many of the District’s bike lanes, putting cyclists at risk of serious injury.

### Reckless Driving

Despite the city’s efforts to promote bike safety, drivers still don’t always obey traffic laws or pay attention when sharing the road with cyclists. Some drivers even exhibit aggressive driving behaviors around cyclists. Reckless driving can lead to dangerous situations and even fatalities.

Distracted driving is also a major concern. With the rise of smartphones and other technologies, more drivers are engaging in distracted driving behaviors, such as texting or browsing social media while behind the wheel. Distracted driving puts not only cyclists, but all road users, in danger.

### Door Zone Accidents

Another danger cyclists in DC face is the “door zone” accident. This scenario occurs when a cyclist is riding too close to parked cars, and a driver opens their door, striking the cyclist. The sudden impact of the open door can cause cyclists to lose control and crash. To avoid this type of accident, it is essential for cyclists to stay a safe distance away from parked cars and to remain alert at all times. Unfortunately, this is not always the case due to the lack of bike lanes with ample space to avoid cars.

### Bike Lane Infrastructure Design Flaws

As mentioned, the bike network in Washington, DC, still needs to be completed. Many existing lanes suffer from inadequate design flaws that put cyclists at risk.

Poorly placed or obstructed bike lanes can leave cyclists vulnerable to traffic, while dangerous intersection designs can lead to serious accidents. Many intersections in the city are confusing or even hazardous for cyclists. For example, some intersections force cyclists to merge with traffic while turning, creating a dangerous situation.

In addition, some existing bike lanes are not adequately protected from traffic and can leave cyclists feeling exposed and unsafe. To ensure the safety of all road users, cities need to review their bike lane infrastructure and make necessary improvements regularly.

If you have been injured while biking due to the negligence of others, it is essential to speak with a qualified attorney as soon as possible. An experienced bike accident lawyer can help you understand your legal rights and options and will fight for the compensation you deserve. Don’t let dangerous roads put your safety at risk—take action today.

• Report any dangerous conditions you encounter on your rides.

• Make sure your bike is in good condition and equipped with proper safety lights and reflectors.

• Avoid high-traffic areas whenever possible, or plan bike routes that follow quieter side streets.

By following these tips, cyclists can remain safe while riding in DC—and enjoy the many benefits of cycling in our nation’s capital.

Safety starts with each of us—cyclists and drivers alike. By following these tips, cyclists can remain safe while riding in DC—and enjoy the many benefits of cycling in our nation’s capital.

## Protected Bike Lanes For Safer Cycling

The DDOT in DC recognizes the importance of protected bike lanes, also called Cycle Tracks or separated bike lanes. The DDOT has been actively working to implement them throughout the city. The department has set a goal of achieving 20 miles of protected bike lanes by 2024 and has already made progress toward this goal. In 2020, the DDOT installed six miles of protected bike lanes, including the city’s first two-way protected bike lane.

These lanes not only provide a safer and more comfortable riding experience for cyclists but also help to address the issue of incomplete bike networks by creating a more connected and cohesive system of bike infrastructure. The DDOT’s commitment to implementing protected bike lanes is an essential step toward creating a safer and more sustainable transportation system in DC.

## Pursuing a Safer Cycling Space For All

By addressing the safety issues of bike lanes head-on and investing in protected bike lanes and other safety measures, we can create a safer and more accessible transportation system for all road users. As we work toward a safer and more sustainable future, we must prioritize the safety and well-being of cyclists and other vulnerable road users.
