Partner Joseph Cammarata successfully secured a $1,250,000 settlement in a rear-end car crash case in Warren County, Virginia.
Our client, a lawyer and passionate photographer, was traveling near the Shenandoah Mountains in search of a scenic location to photograph the Milky Way. As she slowed to turn into a parking lot, another driver took his eyes off the road—likely to look at his phone or radio—and violently struck the rear of her vehicle.
As a result of the crash, our client suffered severe injuries, including a traumatic brain injury with brain bleeding; visual deficits such as difficulty focusing at close range, double vision, and blurred vision; and gait imbalance. These visual impairments made it difficult for her to read even short items and caused significant discomfort and exhaustion during prolonged reading or computer work. As both a lawyer and an avid photographer, these injuries had a substantial negative impact on her professional and personal life.
Mr. Cammarata filed suit in the Warren County Circuit Court and engaged in extensive fact-finding and development of the client’s damages claims. Through this process, he was able to persuade both the at-fault driver’s insurance carriers and the client’s own insurance carriers to collectively resolve the matter for a total settlement of $1,250,000.
