It is a comparison between a bullet of an automobile and a bomb of a tractor trailer. Allan Siegel: There’s a lot more involved in a truck crash case than there is in a car crash case. And not every law firm knows and understands trucking cases. There are federal rules and federal regulations that govern the trucking industry that they must follow, and a lawyer who’s handling those types of cases needs to know all of those laws, needs to know hours of service, needs to know how they’re supposed to keep their logs. I am on the executive board of the AAJ Trucking Litigation Group. I will eventually be the chair of that group. I’ve worked with that group and been on the board for many years and have been working and have a deep understanding of trucking cases. Joseph Cammarata: If it’s a heavy use vehicle, dump truck, a garbage truck, U-Haul, tractor trailer, 18 wheeler, those are trucks. So we’re not just talking about 18 wheelers. Those big rigs that you see on the road. Stephen Ollar: It’s not always just the truck that’s at fault. Maybe the truck trucking company itself was negligent in not providing enough supervision for the truck driver. So there’s a lot that goes into it, and it’s something that we pride ourselves in. Walmart officials have announced that an[ undisclosed settlement ](https://www.chaikinandsherman.com/2008/03/learning-about-a-lawsuit/)has been reached over a [truck accident](https://www.chaikinandsherman.com/2017/04/why-truck-accident-cases-are-so-complex/) that seriously injured Tracy Morgan and three other victims, one of whom died in the crash. The accident, which occurred last year, made national headlines not just because a celebrity was involved, but also because the[ details of the accident ](https://www.chaikinandsherman.com/2015/07/six-killed-12-injured-in-9-vehicle-tractor-trailer-crash/)raised questions about Walmart’s safety policies regarding truck drivers. **Here are details about the crash and the settlement:** * The crash took place on the New Jersey Turnpike in June 2014 when a [Walmart tractor-trailer](https://www.chaikinandsherman.com/2007/05/beware-of-the-tractor-trailer/) rear-ended a limo in which Morgan was a passenger. Morgan suffered serious injuries that required surgery and a lengthy recovery process. Two other passengers in the limo were injured in the accident, and a third passenger, a friend of Morgan’s was killed. * Federal investigators with the National Transportation Safety Board (NTSB) reported that the Walmart truck had been going 20 mph over the speed limit before and that its driver had been awake for over 24 consecutive hours before the crash. * Many safety experts called attention to the fact that the truck driver was approaching his drive limit – the limitation for how long commercial drivers can be on the clock or on the road. More concerns were expressed when it was discovered that the driver, who lived in Georgia, drove over 11 hours to start his shift in New Jersey despite the fact that there were other distribution centers closer to his home. * The lawsuit – which was filed on behalf of Morgan, two of the injured passengers, and the then-pregnant wife of one of the passengers – alleged that Walmart was [negligent in allowing its driver](https://www.chaikinandsherman.com/2010/05/miscellaneous-rules-for-tractor-trailer-operators/) to travel such a long distance before starting his shift. The lawsuit was settled for a confidential amount.
