California Federal Judge Allows Cab Companies Claims Against Uber to Continue

A federal judge in California has denied Uber’s motion to dismiss a lawsuit by 19 cab companies against Uber for making false claims on ride safety. On its website, advertisements, and other press statements, Uber had claimed it offered the “safest rides on the road”. The cab companies argued that they, in fact, offered the safer rides as they put their drivers though background checks, made drivers take safety classes and exams, and adhere to more stringent vehicle inspection standards. Uber argued that its claims were mere “puffery” including one ad claiming “Background checks you can trust”. The judge disagreed with Uber and found that the statement do not simply assert that Uber places a high priority on safety but instead included asserts on which a reasonable consumer would rely. The judge reasoned that some of Uber’s claims, including a “best-in-class-safety” claim, could be viewed by a reasonably consumer as an objective fact.Uber Accident Lawyer

While Uber may argue that its claims are just “puffery” or “generalized statement of aspiration and optimism” the reality is that many passengers who use the service believe these claims and rely on them when choosing to use the service. It also means that many drivers on the road are also relying on, or at least hoping, that these claims are true as well. As the number of Uber drivers continues to rise, more drivers, many of whom have no specialized training or oversight beyond having a basic driver’s license, will be on the road picking up passengers and driving on the roads. Now most people on the road do not have any training beyond getting a driver’s license, however, those people are not necessarily picking up and transporting people around cities and metropolitan areas for a fee. Uber drivers, whether professional car service operators driving between scheduled fares, or just your Average Joe’s with a Toyota and spare time, are responsible for exercising reasonable care in the transport of their passengers and ensuring that their passengers safely arrive at their destination.
