In a recent case, we represented a family that suffered serious injuries when a tire on their SUV separated. The family had been driving on the highway when the car lost control and ran off the road. The family did not realize that the tread of the tire had separated, and it was alleged that our client was at fault for losing control of the vehicle. Our client went to the scene a few days later, found the tire, and began to piece together that the tread had separated.

Our firm was able to discover that the tire was defective, and that it had been recalled approximately 10 years before the accident. The family never received a recall notice. It was also an "aged" tire that was a full-sized spare which had never been used. Because our client had a flat tire a few weeks before the accident, he took the car to the dealer and the flat was swapped with the 10 year old recalled spare tire. The dealer never should have put a recalled tire on the vehicle, nor should they have put a tire that was over 10 years old. The tire should never have been on the road.

As a result of the accident, the front seat passenger suffered a severe broken leg and was required to have multiple surgeries. The driver suffered a fractured wrist, and the rear seat passenger – their son – suffered broken ribs and a shoulder injury. The lawsuit was filed against the tire manufacturer, the dealer who put the tire on the vehicle, and multiple other service providers that failed to notify our clients about the recalled tire. The case settled for a confidential amount.
