The firm has secured over $3.5 million for a cyclist who suffered a traumatic brain injury in a dooring incident. Video Transcript **Speakers:** Joseph Cammarata, Stephen Ollar, Allan Siegel **Allan Siegel:** Being in the District of Columbia, which is a very bicycle friendly city, we get a lot of bicycle crashes. A lot of clients who are involved in bicycle crashes reach out to us and we’ve been handling them for years. Whether or not it’s somebody driving in a bike lane and somebody makes a turn and infringes upon the bike lane, whether it’s somebody who gets “doored” by another vehicle, in other words, a driver stops and opens his door while the bicyclist is driving with the right of way. That actually is against the law in the District of Columbia. You’re required to look before you open your door or whether or not it’s just a case where a bicycle’s riding on the roadway and with the right of way and a vehicle makes a turn or rear ends them. We get a lot of them, and we’ve been handling them for many, many years and very successfully. **Stephen Ollar:** Really, when you look at the law in DC what we talk about is vulnerable riders. So it’s not just bicyclists, it’s also motorcyclists. It’s people on e-scooters, even pedestrian, all of them who are, anybody who’s not inside a four wheeled vehicle, falls under that kind of category of a vulnerable user. And so the law in that area is consistent across the board. The law now in the District Columbia, is that if you fall into that kind of category, you could be up to 50% at fault and still be able to get a recovery. You can’t be more than 50% at fault, but as long as you’re 50% or less, you’re still eligible to get a recovery. So we do a lot of those cases and providing representation for people over hurt in those categories. **Joseph Cammarata:** So it’s important to reach out to a lawyer that knows what they’re talking about that’s going to be aggressive and going to be able to establish that your fault was slight, if any, and that you have a full opportunity to receive compensation for the harms and losses that you suffered. Washington D.C. and Baltimore were just named among the top 5 on a list of cities with the [least courteous drivers](https://www.chaikinandsherman.com/2013/11/how-dangerous-is-it-to-ride-a-bike-in-dc/) on the road according to the 2014 study conducted by AutoVantage, a roadside assistance service. So how can we beat the road rage and stay calm during our commutes? Fortunately, Washington, D.C. is also high on the list of commuters who choose to walk or bike rather than drive. D.C. ranks 2nd the list of the cities with the highest rate of walking to work, with 12.1% of commuters choosing the stress free option of walking. Also high on the list of cities with commuters choosing to walk was Boston ranking 1st, Pittsburg ranking 3rd, and Baltimore also made the list ranking 12th. Another option available to help beat road rage is[ biking to work](https://www.chaikinandsherman.com/2015/10/bicyclist-injuries-on-the-rise/). This is especially true in areas where bike lanes are separate from the flow of traffic [offering bicyclists safety](https://www.chaikinandsherman.com/2014/01/are-inflatable-bike-helmets-safer-than-standard-helmets/) from being cutoff or pushed off the roadway. D.C. has built more than 50 miles of safe bike lanes, and plans to add 14 more miles in 2014. D.C. ranks 7th on the list of cities with the highest rate of commuters biking to work. The Capital Bikeshare program has also created a spike in bike usage in and around D.C., with Bikeshare stations set up from Gaithersburg, Maryland down to Alexandria, Virginia. A study by the Census Bureau found that nationwide the amount of commuters choosing to bike to work has increased 60% over the past 10 years, and is expected to continue to rise. The study also found that the average commuting time for bicyclists was only 19 minutes. These less stressful options for commuting decrease the traffic on our roads, decrease the pollution from cars, and provide health benefits in the form of daily exercise. But, now that nice weather has returned and you hit the streets for your commute, **please be sure to always stay alert**. Pedestrians should always look both ways before crossing the street and stay within crosswalks. Bicyclists should follow all traffic laws, always signal for every turn, and be conspicuous with lights and bright colored or reflective clothing. Most importantly, drivers should always be alert for pedestrians and bicyclists. Unfortunately, the fact that there are so many pedestrians and bicyclists, means that there are also too many [bicycle accidents](https://www.chaikinandsherman.com/bicycle-accidents/ "bicycle accidents") and pedestrian accidents.
