Ira Sherman:

The operator of a tractor trailer has a special responsibility because that, as a weapon, is way more powerful than an automobile could be if it struck you in the rear or anywhere. It is a comparison between a bullet of an automobile and a bomb of a tractor trailer.

Allan Siegel:

There’s a lot more involved in a truck crash case than there is in a car crash case. And not every law firm knows and understands trucking cases. There are federal rules and federal regulations that govern the trucking industry that they must follow, and a lawyer who’s handling those types of cases needs to know all of those laws, needs to know hours of service, needs to know how they’re supposed to keep their logs. I am on the executive board of the AAJ Trucking Litigation Group. I will eventually be the chair of that group. I’ve worked with that group and been on the board for many years and have been working and have a deep understanding of trucking cases.

Joseph Cammarata:

If it’s a heavy use vehicle, dump truck, a garbage truck, U-Haul, tractor trailer, 18 wheeler, those are trucks. So we’re not just talking about 18 wheelers. Those big rigs that you see on the road.

Stephen Ollar:

It’s not always just the truck that’s at fault. Maybe the truck trucking company itself was negligent in not providing enough supervision for the truck driver. So there’s a lot that goes into it, and it’s something that we pride ourselves in.

Truck Accidents in DC

While Washington DC experiences a significant amount of heavy truck traffic due to its status as a hub for commerce and activity, it has admirably maintained relatively low rates of accidents involving these large vehicles. Accounting for just 2% of such mishaps countrywide, the District of Columbia ranks among the states with the least occurrences of crashes involving large trucks. This is a testament to the effective road safety measures and responsible driving practices in place within the city.

Furthermore, the impact of these accidents on human life in DC is also considerably low when compared to other regions. The year 2021 saw only a single fatality resulting from a large truck crash in the District of Columbia, indicating a substantial success in minimizing the most severe consequences of these incidents. These statistics underscore the importance of sustained efforts towards promoting road safety and responsible driving behaviors.

Nationwide Truck Accident Statistics

Across the United States, truck accidents make up a significant portion of highway incidents, representing a serious risk to public safety. In 2020, according to the Federal Motor Carrier Safety Administration (FMCSA), there were approximately 415,000 police-reported crashes involving large trucks. Tragically, 4,444 of these incidents resulted in fatalities, underscoring the devastating potential of these occurrences.

Furthermore, 72% of these fatal truck crashes involved a large truck colliding with other vehicles in transport. This statistic highlights the dangers not just to the truck drivers themselves, but to all road users. The sheer size and weight of these vehicles amplify the impact of any collision, often resulting in severe injuries or fatalities.

Why Are Large Truck Crashes So Dangerous?

Large truck crashes are particularly hazardous due to several factors. The first, and perhaps most obvious, is the sheer size and weight of these vehicles. A typical commercial truck can weigh up to 30 times more than a passenger car. This massive weight disparity means that in a collision between a truck and a smaller vehicle, the smaller vehicle (and its occupants) bear the brunt of the impact. In addition, the substantial size and weight of trucks also affect their maneuverability and stopping distance.

Trucks take longer to stop than passenger vehicles, especially when they are fully loaded. Even under ideal conditions, a loaded tractor-trailer will take 20-40 percent farther than a car to stop, and the discrepancy can be even greater on slippery roads or with poorly maintained brakes.

Moreover, the size and structure of trucks make them less agile, making turns or sudden maneuvers more challenging. This decreased maneuverability can lead to unsafe situations, especially in heavy traffic or on narrow roads. The significant size and weight, combined with operational challenges, make large trucks inherently riskier on the road, with a much higher rate of fatal crashes than passenger car accidents. The dangers of trucks warrant extra caution from both truck occupants and other road users.

Common Causes of Truck Accidents

According to the Federal Motor Carrier Safety Administration (FMCSA), these are the top reasons for truck accidents in the United States:

Driver Error

Driver error exceeds all other factors as the cause of truck accidents, being ten times more likely to be the root cause. Key drivers of such errors include physical impairment, inattentiveness, misjudgment of speed or following distance, and inappropriate response in panic situations.

Need for Enhanced Driver Training

Given that driver error significantly contributes to truck accidents, there is a clear need for improved driver training. Increased freight movement over the coming years and a current driver shortage necessitate the hiring of younger, less experienced drivers. The Federal Motor Carrier Safety Administration is examining training requirements to enhance road safety.

Equipment Failure

Even the best driver can be compromised by mechanical failures. More than half of injury-invoking truck accidents involve at least one mechanical failure, such as faulty brakes, worn tires, defective lights, or overall poor maintenance. The FMSCA mandates pretrip and regular inspections to prevent equipment failure.

Company Priorities

Organizations sometimes prioritize meeting client deadlines over road safety, potentially leading to unrealistic schedules, driver fatigue, and an increase in accident likelihood. These preventable accidents can result in significant costs for employers in terms of medical care, legal expenses, property damage, and lost productivity.

Substance Abuse

Substance abuse screening at the time of hire and throughout employment can ensure drivers are not under the influence of any substance that would compromise their safety and the safety of others. This is an important strategy for preventing accidents.

How to Prevent Truck Crashes

Truck safety is everyone’s responsibility, and there are various measures that truck drivers, their employers, and other road users can take to minimize the risk of crashes. Some strategies include:

Enhanced Driver Training: Given the high rate of fatal large truck crashes, improving driver training is imperative. This includes comprehensive courses on safe driving techniques, understanding of vehicle dynamics, proper load management, and emergency response training. Encouraging continuous education can also keep drivers up-to-date with the latest safety regulations and practices.

Routine Vehicle Inspections and Maintenance: To prevent mechanical failures that can lead to accidents, regular inspections and maintenance of the trucks are crucial. This includes checking the brakes, tires, lights, and other critical components. Trucking companies should establish a routine inspection schedule and enforce strict adherence to it.

Strict Adherence to Speed Limits: Over-speeding is a common cause of truck crashes. Drivers should be educated about the dangers of speeding and should strictly follow the set speed limits. Trucking companies can use technology such as speed limiters to enforce this.

Proper Rest and Breaks for Drivers: Truck driver fatigue is a significant contributor to truck accidents. Drivers should take appropriate rest breaks and comply with hours-of-service regulations to prevent fatigue-related accidents. Companies should also prioritize their drivers’ health and well-being over tight delivery schedules.

Zero-Tolerance towards Substance Abuse: Enforcing strict rules against substance abuse is crucial. This includes regular screening for drugs and alcohol at the time of hiring and throughout employment. Any signs of substance abuse should be dealt with promptly and appropriately.

Adherence to Load Limits: Overloading trucks can affect their maneuverability and increase the risk of accidents. Drivers and trucking companies should strictly adhere to the load limits specified by the manufacturers.

Use of Safety Technologies: The use of safety-enhancing technologies such as collision avoidance systems, electronic stability control, and lane departure warning systems can significantly reduce the risk of truck crashes. Trucking companies should invest in such technologies and train their drivers to use them effectively.

Promoting Defensive Driving: Encouraging defensive driving can help prevent accidents. This includes maintaining a safe distance from other vehicles, being vigilant about the road conditions and other drivers, and being prepared for unexpected situations.
