Deadly Accident on Canal Road Could Have Been Prevented.

Two men were killed on January 14, 2011 in a fatal car crash that occurred on Canal Road between Clark Place and Reservoir Road.  The driver of the vehicle, Milos Milicevic was driving on Canal Road shortly before 5 a.m. when he lost control of his 2001 Jaguar on ice.  The car slid across the road and into oncoming traffic.  This particular area of Canal Road has been a trouble spot for years.  The law firm of Chaikin, Sherman, Cammarata & Siegel, P.C. handled a similar case that occurred when a vehicle lost control on ice, in the exact same location.  Our client also died, and the Estate filed a wrongful death lawsuit against the District of Columbia and the United States of America alleging that both entities were negligent in allowing the ice to accumulate and remain on the roadway. The problem is that water flows down the adjacent hill and collects on Canal Road.  When it is cold the water freezes causing a very dangerous condition.   The District of Columbia, and the Federal Government, which owns the adjacent land, have known about this condition since, at least, the early 1990’s when the law firm filed its suit.  The lawsuit was settled.  However, neither entity has done anything to repair this deadly hazard, thereby allowing this terrible tragedy to happen.  Unfortunately, there will be more tragedies until the government fixes this dangerous roadway.  Many people feel if you lost control on ice that it is your fault, and that you cannot recover.  However, if the roadway was negligently maintained you may have a cause of action.  If you or a family member have been injured because of icy road conditions you should contact the lawyers at Chaikin, Sherman, Cammarata & Siegel, P.C.
