CSCS's Experience with Metro Accident Litigation

Handling Washington D.C. Metro Accident Cases

The attorneys at Chaikin, Sherman, Cammarata & Siegel, P.C. have extensive experience litigating cases against the Washington Metro Transit Authority ("WMATA" or "Metro") as well as Amtrak and CSX Transportation. The firm has successfully litigated train crashes and derailment cases, as well as cases involving negligent maintenance of train equipment, escalators and platforms.  In fact, the firm has represented victims from every major catastrophic train accident that has occurred in the District of Columbia metropolitan area during the last 13 years.  In particular, the firm litigated a case against Metro resulting from the 2004 train crash that occurred in the Woodley Park Metro station (NTSB Official Report). Read about the Woodley Park Railroad Accident in the Washington Post.

In that case, as in the most recent red line crash, the colliding train climbed on the roof of the other train, and sheered the aluminum shell off one of the cars.   In fact, the 2004 train crash resulted in the National Transportation Safety Board ("NTSB") recommending that Metro retire its older railcars with cars that are more crashworthy, or in the alternative that the older railcars be rehabilitated to incorporate the crashworthiness collision protection that its more modern railcars have.  Sadly, Metro did not implement these recommendations, which contributed to the catastrophic injuries suffered in the June 22, 2009 Metro train crash.

The victims in the 2004 metro train crash not only were entitled to recover compensation for the physical injuries they suffered, but also for the emotional suffering they endured as a result of being involved in such a traumatic event.  The 2004 collision caused black smoke to fill the station, and sent passengers running for their lives.  Our client, who worked for a local school, and was there on a school trip with many children remembered that she thought she was going to die.

The firm also represented a victim who was injured in the 2002 Amtrak derailment in Kensington, Maryland, as well as the 1996 derailment of a MARC Train in Silver Spring.  Our clients in these cases were also not only compensated for their injuries, but also received compensation for the emotional turmoil that these catastrophic incidents had on them.
