The Metro collision resulted in the deaths of 9 people, and physical injuries to at least 70 to 80 other people. The law firm of Chaikin, Sherman, Cammarata, Siegel, P.C. is representing the estate of one of the persons killed in the collision, and is also representing an individual who suffered physical and psychological injuries from the collision.

The law firm recently filed a lawsuit against WMATA and Alstrom Signaling, Inc., an entity involved in providing train traffic control systems to WMATA, in the U.S. District Court for the District of Columbia. The Complaint filed on behalf of the Estate of the deceased individual seeks compensation for wrongful death, and pain and suffering before death, based on negligence.

As part of the negligence claim, the Complaint charges WMATA/METRO with a failure to warn its passengers, such as our client, that the train involved in the crash was not safe and had a tendency to telescope, eliminating passenger survival space within the train. At least three years before the June 2009 crash, WMATA/METRO was warned by the National Transportation Safety Board that the type of train car involved in the collision needed to be replaced because it was not safe for passengers in the event of a collision.

Owner of Campground Killed When Run Over by a Tractor-Trailer Driver

The law firm of Chaikin, Sherman, Cammarata & Siegel, P.C. has been retained by the wife of a man who was run over by a truck at the Picture Lake Campground in Petersburg, Virginia. Our client’s husband owned and managed the campground and was working at the time. The truck driver was trespassing on the premises, and our client’s husband stopped him to determine the why he was on the campground. Our client’s husband stepped up to the tractor-trailer driver’s window, when the truck driver recklessly pulled away, causing our client’s husband to fall backwards to the ground. The truck driver did not stop, or make any attempt to determine where our client’s husband was located, but instead continued to drive off, causing the truck to strike and run over our client’s husband. Our client’s husband suffered severe traumatic injuries and ultimately died. He was 57 years old at the time of his death, and has been described by relatives as a quiet family man, who managed and owned the campground. The law firm has recently filed suit in the Circuit Court for Dinwiddie County, Virginia.

Suit Filed in June Fireworks Tragedy

On June 5, 2009, The Washington Post reported on a tragedy which occurred at a town-sponsored fireworks show in Vienna, Virginia on July 4, 2007 in Vienna, Virginia on July 4, 2007. Partner Joseph Cammarata was featured in the article which recounted the horror of our clients (a father and son) being injured when the fireworks exploded in the crowd. Our clients were seated within the town’s designated “safe zone”. The law firm has filed a lawsuit against the Town of Vienna, the fireworks company and others to seek compensation for our clients’ injuries. The suit is pending in the Circuit court of Fairfax County, Virginia.

Following publication of The Washington Post article, there was intense media interest in the tragedy. Partner Joseph Cammarata and the family of the injured clients held a press conference which was featured on the local affiliate news stations of all major networks, NBC, CBS, ABC, and Fox.

As reported on NBC.

CHAIKIN, SHERMAN, CAMMARATA & SIEGEL, P.C. ETHIOPIAN HERITAGE COLLEGE SCHOLARSHIP FUND

In 2008, the Chaikin, Sherman, Cammarata & Siegel, P.C. Ethiopian Heritage College Scholarship Fund was created in order to help members of the Ethiopian community pay for their college education. The purpose of the fund is to find and then help youngsters with few financial resources obtain a much-desired college degree so that they may then go serve the public. CSCS, P.C. strives to encourage the development of intellect, wisdom, and integrity in those they help, and the firm strongly believes this can be accomplished as can any other goal you long to achieve.

PARTNERS ACHIEVE PRESTIGIOUS HONORS

The law firm of Chaikin, Sherman, Cammarata & Siegel, P.C. is proud to announce the recent, impressive accomplishments of two of its partners. Joseph Cammarata has been named to Washington, DC Super Lawyers 2008 by Law & Politics magazine and was also named to Super Lawyers in 2007. This prestigious honor involves a selection process that evaluates peer recognition and professional achievement.

WASHINGTONIAN MAGAZINE FEATURES CHAIKIN, SHERMAN, CAMMARATA & SIEGEL, P.C.

The October issue of Washingtonian Magazine featured Partners Ira Sherman and Joseph Cammarata. Many of your are aware of the involvement of Chaikin, Sherman, Cammarata & Siegel, P.C. in the Ethiopian community. The law firm is associated with esteemed counsel of Ethiopian heritage, Aseged Yimer, whose offices are located in Silver Spring, Maryland. The law firm has also established the “CSCS Ethiopian Heritage Scholarship Fund”, which will be awarded to the successful applicant in the summer of 2008, providing a subsidy for a successful college applicant entering into their freshman year in the Fall of 2008.

We also have real life experiences helping members of this community. One day, Mr. Cammarata was speaking with the owner/operator of the frankfurter stand at the corner of Connecticut and N Street, N.W. She was complaining that because the high rise building was being resurfaced her stand had been moved down Connecticut Avenue approximately 25 feet. The effect of being 25 feet from the corner was the difference of having shade from the tree at the corner and not having the shade.

This was of particular significance to the lady owner of the frankfurter stand. Mr. Cammarata quickly swung into action utilizing his most effective lawyering skills and he convinced the management to return the lady to the shaded spot on the corner of Connecticut and N Street. CSCS prides itself on representing individuals who have valid claims that are significant to them although, they may not have monetary value. All people and every claim that we serve as advocates for, are treated with equal fervor. When a Washingtonian Magazine reporter heard about this, he found it newsworthy and put the story on page 15 of the October edition.

PARTNER ALLAN M. SIEGEL COMPLETES HIS TERM AS PRESIDENT OF THE TRIAL LAWYERS ASSOCIATION OF WASHINGTON, DC

On May 9, 2009 Partner Allan M. Siegel‘s term as President of the Trial Lawyers Association of Washington, DC “DC-TLA”) will officially end at the organization’s Annual Awards Dinner. When Mr. Siegel’s tenure as President started this country was in the twilight of the Bush years, and we did not know what the future would bring for the civil justice system in America. Hillary Clinton and Barack Obama were still battling for the democratic nomination, and it was unclear as to who would occupy the White House, or which party would dominate the Congress.

During his year as President, we witnessed the democrats take back the White House and the Congress, which is a very positive development for individual rights and the preservation of the civil justice system. In fact, there is a clear shift taking place in Washington, DC, on both the federal and local level, in favor of the protection of individual rights. For example, there are currently four bills pending on Capitol Hill which would significantly protect consumers.

The Sunshine in Litigation Act would restrict protective orders and secrecy agreements in Federal cases. A bill like this could have potentially prevented hundreds of deaths caused by the shredding of Firestone tires, the dangerousness of which were shrouded by court secrecy agreements before 2001. The Nursing Home Arbitration Act would prohibit binding mandatory arbitration agreements in nursing home contracts, safeguarding the legal rights of a vulnerable population. The Medical Device Safety Act will restore the rights of patients injured by faulty medical devices – a right patients lost last year as a result of the Supreme Court’s decision in Riegel v. Medtronic. Lastly, the Arbitration Fairness Act of 2009 bill will eliminate unfair binding mandatory arbitration contracts in consumer agreements.

During Mr. Siegel’s presidency there were also great strides made in the District of Columbia. DC-TLA worked hard to successfully achieve the goal of electing thirteen DC council members who are empathetic and sympathetic to the rights of District of Columbia citizens to access the courts and obtain justice. The city published regulations designed to implement a law that members of DC-TLA were instrumental in drafting, which requires the city insurance office to hold hearings to monitor requests for malpractice insurance rate increases. Most recently, a bill called “The Insurance Claims Consumer Protection Amendment Act of 2009” was introduced. This bill is designed to provide consumers more equitable treatment from their insurance companies.

In addition, during his presidency the organization continued to provide quality educational programs to lawyers throughout the DC metropolitan area, creating innovative programs, many of which sold-out. Mr. Siegel intends to stay involved in the organization, having recently been elected to serve as the organization’s delegate to the national organization – The American Association for Justice.

PARTNER ALLAN M. SIEGEL IS ELECTED AAJ DELEGATE

On April 2, 2009 Partner Allan M. Siegel was elected by the members of the Trial Lawyers Association of Metropolitan Washington, DC (“DC-TLA”) to serve as DC-TLA’s delegate to the American Association for Justice (“AAJ”). DC-TLA is the local affiliate of AAJ, which is a national association of trial lawyers, whose goal is to preserve and protect the civil justice system in America. Mr. Siegel will be completing his term as President of DC-TLA on May 9, 2009. He will be passing the reigns of that organization over to his predecessor at the Annual Awards Dinner on May 9, 2009. Mr. Siegel has served as the Secretary, Treasurer, Vice President, and President-Elect, before serving as the 2008-2009 President of DC-TLA. He also served on the Board of Governors from 1998-2004. He is looking forward to his new position with the national association. The law firm of Chaikin, Sherman, Cammarata & Siegel, P.C. is a member of the Leaders Forum of AAJ, and partner Ira Sherman, serves as a chairman of one of AAJ’s litigation groups.

JOSEPH CAMMARATA NAMED TO LIST WASHINGTON DC SUPER LAWYERS 2008

We are happy to report that partner, Joseph Cammarata, has been named to Washington DC Super Lawyers 2008 by Law & Politics magazine. Mr. Cammarata was also named to Super Lawyers 2007. ALLAN M. SIEGEL WILL TAKE OVER AS PRESIDENT OF THE TRIAL LAWYERS ASSOCIATION OF WASHINGTON, DC ON MAY 10, 2008

On May 10, 2008 Partner Allan M. Siegel will be inducted as the President of the Trial Lawyers Association of Washington, DC (“DC-TLA”) at is Annual Awards Dinner which is being held at the National Press Club in Washington, DC The organization will also be honoring the American Association of Justice President, Kathleen Flynn Peterson, Retired Maryland Court of Appeals Judge Howard Chasanow, and Robert Peck of the Center for Constitutional Litigation.

DC-TLA is an organization which is dedicated to preserving the rights of, and advocating on behalf, of those who are injured by the negligence of others. Its members share an abiding commitment to maintaining a civil-justice system that enables citizens to have their claims for full and fair compensation adjudicated by a trial by jury. The organization supports the legal community by championing legislation that promotes and protects our clients’ rights and by providing high-quality educational programs for its members. Allan will have served as the Secretary, Treasurer, Vice President and President-Elect of the organization prior to his taking over as President on May 10, 2008. Allan will be the third member of Chaikin, Sherman, Cammarata & Siegel, P.C. to have been President of this prestigious organization, following in the footsteps of Donald Chaikin, Partner Emeritus, and Partner Ira Sherman.

PARTNER ALLAN M. SIEGEL ACHIEVES A JURY VERDICT GREATER THAN THE INSURANCE POLICY

Congratulations to Allan Siegel who received a jury verdict in excess of $104,000 in a case that was tried in the Circuit Court for Prince George’s County, Maryland. The offer in the case was $20,000 and total amount of available insurance was $100,000. Mr. Siegel and the law firm of Chaikin, Sherman, Cammarata & Siegel, P.C. refused to accept the low ball offer made by State Farm Insurance Company and challenged them before a jury in the Circuit Court for Prince George’s County.

The jury understood the damages sustained by our client and issued their verdict, exposing State Farm Insurance Company to a bad faith claim. Congratulations to Allan and our client. This case is another example of how to show that Chaikin, Sherman, Cammarata & Siegel, P.C. is fighting for you and the courtroom is our battleground, we fight for you!

THE MAYOR FINALLY RELENTS AND SIGNS THE FRANK HARRIS, JR. JUSTICE ACT OF 2008 INTO LAW

On January 23, 2008 the Honorable Mayor Adrian Fenty concluded the long, arduous battle to prohibit the District of Columbia from seeking reimbursement of Medicaid payments made to individuals such as our client, Mr. Frank Harris, Jr. Mr. Harris was injured as a result of the alleged negligence of the District of Columbia while a psychiatric inpatient of St. Elizabeth’s Hospital.

Many of you have been following this case and the story of the remedial legislation introduced by Councilmember-at-large Phil Mendelson and City Council Chair Vincent Gray as a result of the lobbying efforts of partners Ira Sherman and Joseph Cammarata to eliminate the District of Columbia’s unfair negotiating tactic of asserting a lien against the proceeds of any settlement or verdict in situations similar to that in which Mr. Harris found himself. Mayor Fenty had abandoned his previous support of this measure and took the side of the lawyers arguing against Mr. Harris and the law firm of Chaikin, Sherman, Cammarata & Siegel, P.C.

Ultimately, confronted with a veto-proof bill, passed 11-2 by the District of Columbia City Council, the Mayor had virtually no choice but to acknowledge the correctness of the position of the law firm and the vast majority of the members of the City Council by signing the legislation into law. We congratulate the Mayor on exercising the correct and wise approach by signing this bill into law. Needless to say, we at Chaikin, Sherman, Cammarata & Siegel, P.C. are gratified by the result.

ALLAN M. SIEGEL NOMINATED TO BE PRESIDENT OF THE DISTRICT OF COLUMBIA TRIAL LAWYERS ASSOCIATION (DC-TLA)

On January 24, 2008 the District of Columbia Trial Lawyers Association Nominating Committee selected Allan M. Siegel as the nominee to be presented to the Board of Directors, and ultimately to the membership, as the official Presidential nominee for DC-TLA (beginning May, 2008). We congratulate Allan on this outstanding achievement. Allan is following in the footsteps of Donald Chaikin, Esq., Partner Emeritus, and Ira Sherman, Esq., both of whom were former Presidents of the DC Trial Lawyers Association. We are proud to have had three of our partners selected to lead the trial lawyer legal community of the District of Columbia and the public at large in the pursuit of justice for all.

LEGISLATION SUPPORTED BY CHAIKIN, SHERMAN, CAMMARATA & SIEGEL, P.C. ON BEHALF OF ITS CLIENT WAS APPROVED BY DC COUNCIL 11-2 AND SENT TO THE MAYOR FOR HIS SIGNATURE ON JANUARY 14, 2008

The Frank Harris, Jr. Justice Amendment Act of 2008 was voted on, in its second reading, by the City Council of the District of Columbia and approved by a vote of 11-2. This Act and the case of Harris v. District of Columbia, has been the subject of the Legal Blog on this website. The City Council of the District of Columbia has now acted to approve the legislation, which carries the name of a client of this law firm, and will serve to benefit all similarly situated individuals forevermore. We are proud to have not only represented Mr. Harris and successfully concluded his case, but to have successfully lobbied the legislature to introduce and ultimately pass to the Mayor for signature this significant piece of legislation.
